Am I allowed to Leave the State While Out on Bond?

Fizeradmin • Apr 05, 2019

Strictly speaking, leaving the state while out on bail is one of the biggest no-nos in the book. Fortunately, Fizer Bonding Company of Clarksville, TN bail bonds office are usually flexible on this point. If you have a good reason for leaving the state, plan ahead, and contact your bondsman, there’s a good chance you can cross the border and stay out of jail.

There are a number of reasons people may need to travel. Many must travel for work, while others may be called to travel out-of-state to visit a sick relative or some other unplanned occasion. Others have prepaid travel plans which they made many months before they were arrested and they really do not want to lose the time and money already invested.

The travel limitation is not a punishment. It’s a way of guaranteeing that the defendant will appear at trial. Unfortunately, a few people leave the state and never come back. Therefore, the bail bonds process includes this restriction as a protocol.

How Do Bail Bonds Work?

Generally, a bond is a surety. People buy savings bonds and municipal bonds because the federal, state or local government promises to pay interest. A bail bond is also a surety. People pay bail bonds premiums so they may get a friend or loved one out of jail.

Usually, people have two options to get someone out of jail. They can deposit the entire bail amount in cash with the sheriff. The sheriff usually refunds the money after the case is resolved. Or, you can go to Fizer Bonding Company in Montgomery and Robertson counties (bail bond near me) and obtain a surety bond. It has the same effect of getting you quickly out of jail but you only pay a premium for the bond which is usually only a small percentage of the full bail bond amount.

Tennessee law gives both bail bondsman and sheriffs a lot of discretion when it comes to setting the out-on-bond rules. The rules vary greatly from case to case, but some typical ones include:

  • No Travelling : As mentioned, some people who leave the jurisdiction never come back. Many times, surrendering a passport is a condition of bail.
  • Regular Reporting : Periodically checking in at the bail bonds office or with your bondsman serves several purposes. It reminds the defendant that this is serious business, helps the bail bonds office keep up with comings and goings, and gives defendants a chance to ask their questions.
  • Offense-Specific Conditions : If you were arrested for DUI, you probably must install an Ignition Interlock Device in your vehicle. If you were arrested for assault, you probably must stay away from the alleged victim. Those are just two examples. Sometimes you must wear a tracking device so the court can know your whereabouts and travel activity.

Pretty much everything is negotiable. In addition, to traveling out-of-state, people might need a little more time to install IIDs or move out of their current dwellings. If you reach out to your Fizer Bonding Company bondsman before the due date of your court appointments or before there is a problem, we can usually work something out.

As a general rule, it is best to assume that you cannot leave the state of Tennessee while out on your bond and figure that you will need to negotiate that with your bondsman and not just take off and leave. You wouldn’t want your vacation to turn into a manhunt for fleeing on bond.
