Can I Drink While I’m Out on Bail?

Tennessee law gives public and private authorities (courts and Clarksville, TN bail bondsman) broad authority to place “ reasonable restrictions on the activities, movements, associations, and residences of the defendant.”

Often, when defendants post bond with the sheriff, the sheriff gives them a paper with a long list of conditions then cuts them loose without explaining anything. General Conditions

Whether a person has been arrested for an unpaid speeding tickets or was arrested for battery, everyone who is out on bond must abide by some generic conditions. Above all, they must report regularly and avoid any further trouble with the law, at least in most cases.

These general bail conditions may not explicitly say “no alcohol,” but they imply it. Many people make poor decisions when they drink. Furthermore, many people forget important appointments, like checking in with their bail bondsman, when they drink. Violation of any pretrial release conditions usually means bond revocation or forfeiture, so if you mess up on any of these you are subject to re-arrest at any time.

Offense-Specific Conditions

Most pretrial release agreements also contain some offense-specific conditions. These restrictions are not designed to interfere with your lifestyle. They’re designed to keep you out of trouble and keep you from unintentionally violating your bail conditions.

DUI bail bonds often contain provisions related to alcohol consumption. For example, most people out on a first DUI bail must install Ignition Interlock Devices in their vehicles. These “blow and go” gadgets are basically portable Breathalyzers which block the ignition if the driver’s BAC is above a certain level. Furthermore, the driver must provide samples while driving. If there are too many rolling refusals, the vehicle will not restart.

If the defendant is out on a subsequent DUI bail, the no-alcohol conditions are even stronger. The normal IID BAC level is .04, which is about two drinks in most cases. But a subsequent DUI IID may be set at .01. Furthermore, the defendant may have to provide random urine or other chemical tests to make sure the defendant is not drinking. DUI probation usually has similar conditions.

When you are out on bail it is best to proceed with caution if you intend to drink alcohol. Best not to drink and drive at all and keep alcohol consumption to a minimum so you can keep your wits about yourself and maintain good judgement.
