Can You Bail Yourself Out of Jail in Tennessee?

Fizeradmin • Feb 06, 2019

Technically, it’s possible to bail yourself out of jail. You must have sufficient cash on hand to pay the entire bail amount upfront.

However, most people do not have a few thousand dollars in cash in their wallets. If they do, the sheriff will most likely confiscate it as evidence. Furthermore, Tennessee has prosecutor-friendly forfeiture laws which recently earned a D-minus in a national survey. So, if the sheriff takes your cash, you might have a long wait getting it back, even if you are not convicted.

So, pretty much all those who have been arrested need cosigners or people to move money for them. In these cases, it’s usually better to work with Fizer Bonding Company (bail bond near me) when you are arrested in Montgomery and Robertson Counties. Our bondsman can write a bail bond at a fraction of the original cash bond amount. The defendant simply must promise to appear in court and abide by all bail conditions. Generally, bail conditions include things like remaining in the county and checking in periodically.

Do I Need to Bail Out?

Surprisingly, the answer to this question is “not always.” If you have no criminal record and are charged with a Class B or C misdemeanor, the judge may only sentence you to a few days in jail. So, if you have no work, family, education, or other commitments, sitting out the sentence in jail might be an alternative to getting released (although I doubt any more than 1% of the population willingly elects to do this).

But if you do elect to sit out your jail time be aware that there is a risk involved because there is no way to tell what the sentence will be. And, you will not have a defense until you talk to an attorney. There will be plenty of “jailhouse lawyers” in the holding tank with you. But taking legal advice from people who are in jail with you is like taking medical advice from the sick people in the doctor’s waiting room.

In all seriousness, depending on the amount of bail, pretty much everyone should work with a bail bondsman. People who are in jail cannot work, go to school, or spend time with their families. Furthermore, these individuals cannot participate in their own defense in any meaningful way.

How Does Bail Work in Montgomery County?

The sheriff usually sets presumptive bail amounts in criminal cases. To get out of jail right away, the defendant can either pay the entire amount of bail in cash at the jail or work with a Fizer Bonding Company bail bondsman. Our bondsman can write a surety bond for a small premium.

If the sheriff does not set bail, or the defendant cannot afford bail, an attorney can request a bond reduction hearing. At this hearing, the judge will weigh the pros and cons of bail. Then, the judge typically reduces bail to an amount the defendant can afford. Unfortunately, this will usually require more time and money on your part.

Law and Order is a popular TV show that is still shown in reruns, but the subject on the TV show usually has little to do with law and order.
