Help! I Drove on a Revoked License and Got Locked Up!

  • Aggravated driving on a suspended license is at least a Class A misdemeanor (one year in jail and $1,000 fine). Aggravating circumstances include a second offense or additional facts, like a suspension due to vehicular manslaughter.

Knowledge of the suspension is an element of this offense. However, the statute presumes that notice is complete once the state mails something to your address of record. It’s difficult, but not impossible, to overturn this presumption. Probation is a possible outcome, especially in Class B misdemeanors. However, when you are stopped by law enforcement in Robertson and Montgomery Counties there is a possibility that you will go to jail for driving with a suspended license.
