TN Child Support Laws Changed & Got Me Arrested

Fizeradmin • Nov 02, 2018

You may have heard that the Tennessee child support collection law recently changed http://www.tba.org/journal/ modifications-to-child- support-laws-in-2017. That’s partially true. Lawmakers made some technical amendments to things like the statute of limitations and interest rates, both of which, if they affect your current child support situation, could force the issuance of a bench warrant. But the mechanics of child support collection are largely unchanged.

Typically, the state starts with wage withholding orders and bank account garnishments. But if you are a parent without a regular job and/or bank account, you are at risk of being arrested on a bench warrant for failure to pay your child support. If either of these methods fails to facilitate the regular payment of your child support, you can find yourself very quickly in need of Fizer Bonding Company, a bail bond company near you serving Montgomery and Robertson County.

There are a couple of situations that bring about an arrest warrant. Sometimes, the custodial parent will file a motion to enforce the child support payment in family court. That could result in a warrant for nonpayment of child support, a “pay or else” order, or a bench warrant for failure to appear in court.

In other cases, the state could suspend your drivers’ license. The suspension notice will be mailed to you at the “address of record”. The address of record will trace back to the last address you gave the courts. If you have moved, you’ll probably never receive the notice. So, you could be driving with a suspended license and not even know it.

Bonding Companies and Warrants Due to Missed Court Dates

Bench warrants like these are not easy to clear up. As the name implies, a bench warrant means that you are to be arrested and brought before the judge.

Nevertheless, with the services of a well-established bonding company like Fizer Bonding Company, you may be able to work with the court and get the warrant downgraded to a standard warrant. They will work with you to make the process as fast and straightforward as possible. The end result is the same as a regular bail bond. You get out of jail and you’re able to comply with the court’s conditions on your own terms.

Generally, Fizer Bonding Company will work with you and the courts to get the warrant lifted and get the case back on the court’s docket, as outlined below.

Bonding Companies and Suspended Drivers’ Licenses

There is a presumption in Tennessee law that people who drive on suspended licenses are people who don’t really care about or pay attention to the law. This is even more evident when a person says, “I didn’t know about the suspension on my license”. Truth be told, this is usually not a valid defense. So, if you are arrested, you could be facing severe penalties.

This entire situation can be very nerve-racking. If you are behind on your child support payments, you can fly under the radar for a while. But eventually, the state will suspend your drivers’ license. In these cases, it is a good idea to ask Fizer Bonding Company for a free child support warrant check. If you have any kind of child support warrant, this search will find it. Then, you can get ahead of the problem and get the warrant lifted. Once again, you can take care of the situation on your own terms.

You don’t have to go to jail just because you owe back child support. Fizer Bonding Company is here to help you either stay out of jail or get out of jail if you have been arrested.
